We also are having problems with National City not working with us to save our home from foreclosure. We have been trying to work out something since December 2007. Because no progress was made between National City & us, we were forced to file bankruptcy at the end of February 2008. I would like to file a class action law suit against National City Mortgage Co. They are trying to help, but they raised our payments and want us to pay $4300 in closing costs to refi our house. We want to get back in good standing with them, but if we had that type of money, we would have never fallen out of good standings.

Very hard to communicate with; does not respond in good faith or promptly and is not reasonable in the way they deal with minimal late payments.

We have been working with National City with a Short Sale. All 41 pages of our hardship packet were overnighted to a “Short Sale Specialist”, on April 29th. We gave them 3 years of tax returns, 6 months of bank statements, purchase contract, listing agreement, HUD-1 etc . . . The hardship was based on my Husband’s layoff and subsequent new job with 30% of his prior pay. We got confirmation that all paperwork was complete and would be submitted for review. Even our Realtor got confirmation. Our first lender, Wells Fargo, offered $3,000 for a settlement. NC said they would accept nothing less that 10% of the balance owed, which is $6,800. Our first mortgage lender approved our short sale beginning July and even agreed to the 10% settlement to NC. Upon faxing Wells Fargo’s approval to NC, they informed me that they had no hardship / short sale review with them and they charged off our loan. I re-sent all hardship paperwork and they provided a letter that they would only release the lien if we pay the $6,800 in certified funds and agree to make payment arrangement for the balance. Do they even know what a SHORT SALE is?? The $6,800 is coming from the sale of the home, but, the letter states that the $6,800 must be received before they will release the lien. They are going to kill this deal and our home will go into Foreclosure. They know nothing about the short sale process. They do not even have a loss mitigation department. Come to find out this whole time while working with them, we were only speaking to collectors who misleadingly use other titles such as “Short Sale Specialist”, “Account Specialist, “Loss Mitigation Negotiator” I am so with the former NC bank employee above who said we should get together with a Class Action Lawsuit for their misrepresentation, and lack of compliance with the government’s New Mortgage Rescue Plan. They are part of the cause of the collapse by refusing to work with us !!!!!
