BUYER BEWARE.NATIONL CITY IS THE WORST BANK TO WORK WITH. WE HAD SOME TROULBE AND THEY SAID THAT THEY WOULD HELP US BY CUTTING OUR HOUSE PAYMENT IN HALF THEN THEY TURNED AROUND AND PUT US INTO FORECLOUSER. IF YOU HAVE A CHOICE DO NOT GO WITH NATIONAL CITY.

They have never allowed us to make any type of partial payments on our account. It has always been either pay the full amount or nothing. If we were abe to make payments we wouldn't be in this sitaution now. We were sent foreclosure notices after 2 months behind. They would only except 2 months payment. No less.

I beleive National City is hiring in people to recoup as much money from it's mortgage portfolios that they can recoup before a takeover coming soon. It's all numbers thats why they are hard collecting and litigation.

National City Mortgage needs to be held accountible for what they are doing. They seem to WANT homeowners to forclose! We were never late for over 6 years. Then we had a death in the family, had to take custody of a minor child and related legal expenses, so for the past year and a half we have struggled. I contacted NCM(national city mortgage) and let them know what was going on. I was paying marches payment in april, april in may....you get the idea. They seemed happy as long as I was making the hefty late payment as well(70 bucks a month!) Well, a few months back, I was late as usual, and the second month was more than 15 days, they slapped a default notice on us. I admit, we were in error being late, but we were in constant contact and letting them know what was going on, when we expect to get caught up ect... Well, I tried to pay the last months payment, they wouldn't take it! They wanted both months or nothing. They suggested I fill out the hardship packet and make arrangesmnts. They told me to hold on to my payment until a decision was made. I waited and waited, no answer from them. I left messages, no answer. Now, because of no answer it lapses into the third month. I call and offer two months payment while they work on the hardship packet. Nope, they wont do it. I keep calling, no answer. Leave messages, nothing. I call and now get a full voice mailbox. Was told by another worker this worker had till the 14th to answer us. Sorry, I am not waiting that long, as if her answer is no, and the 16th rolls around, they could forclose! I borrow money from a family member, call and make WHOLE three months payment, get confirmation number. Done deal, no more worries, right?? WRONG!!! After a week of DAILY checking my bank account and noticing the money hadn't been taken out, and DAILY checking my mortgate statemnet online which was showing my account was credited, I wrongly assumed perhaps they were just waiting for some reason to do the bank transaction. Well, today, still no money withdrawn from my account, and now it shows on my NCM account returned check!! What? I call, and am told it was returned with no explanation why. Now they want to charge me another 189.00 in fees! I am angry, fuming mad, but want this taken care of and agree to pay. My husband in even madder, and calls them and they say I gave the wrong account number. They are reviewing the recording from my call on the 6th to see if it was my error or theirs and if theirs ,they will return the fees. I am NOT holding my breath. First I don't expect they will return my money, and secondly I seriously doubt they will take this payment either. They are claiming I gave them a 4-5 digit bank account #. Why would they even accept that and how could they error as it is the same account I have been paying from for over 6 years! They are intentionally witholding my payment!! They WANT me to be late. It sure feels that way. I have done everything right from the get-go. As I said, I accept responsibilty for my late payement even though it was a result of outside circumstances, I did everything financial counslers, and Dave Ramsey and others suggest when behind. I have communicated, filled out papers, stayed in touch and even made FULL payment, and yet my payment never gets credited. What is going on??

They are trying to help, but they raised our payments and want us to pay $4300 in closing costs to refi our house. We want to get back in good standing with them, but if we had that type of money, we would have never fallen out of good standings.

We have been working with National City with a Short Sale. All 41 pages of our hardship packet were overnighted to a “Short Sale Specialist”, on April 29th. We gave them 3 years of tax returns, 6 months of bank statements, purchase contract, listing agreement, HUD-1 etc . . . The hardship was based on my Husband’s layoff and subsequent new job with 30% of his prior pay. We got confirmation that all paperwork was complete and would be submitted for review. Even our Realtor got confirmation. Our first lender, Wells Fargo, offered $3,000 for a settlement. NC said they would accept nothing less that 10% of the balance owed, which is $6,800. Our first mortgage lender approved our short sale beginning July and even agreed to the 10% settlement to NC. Upon faxing Wells Fargo’s approval to NC, they informed me that they had no hardship / short sale review with them and they charged off our loan. I re-sent all hardship paperwork and they provided a letter that they would only release the lien if we pay the $6,800 in certified funds and agree to make payment arrangement for the balance. Do they even know what a SHORT SALE is?? The $6,800 is coming from the sale of the home, but, the letter states that the $6,800 must be received before they will release the lien. They are going to kill this deal and our home will go into Foreclosure. They know nothing about the short sale process. They do not even have a loss mitigation department. Come to find out this whole time while working with them, we were only speaking to collectors who misleadingly use other titles such as “Short Sale Specialist”, “Account Specialist, “Loss Mitigation Negotiator” I am so with the former NC bank employee above who said we should get together with a Class Action Lawsuit for their misrepresentation, and lack of compliance with the government’s New Mortgage Rescue Plan. They are part of the cause of the collapse by refusing to work with us !!!!!

National City Mortgage is by far the worst mortgage company I have ever dealt with. They keep trying to bill me for insurance I already hazve. Then they tell me I have to prove it when they had already called my insurance company and confirmed I had insurance. I know this because I contacted my insurance company and they were completely puzzzeled by this action. They told me that I had never had a lapse of policy in all 25 years I have been with them and they even told National City this. They still billed me for no insurance. I would love to file a class action lawsuit against them for their actions and their billing of insurance when I already had insurance. Please, someone refer a good class action laywer to me.

I am disgusted with them. Would NEVER suggest using them. They keep increasing my mortgage telling me I dont have enough flood coverage. I increase the coverage, they tell me its still not enough, and up goes the mortgage. They sure are great about getting you out your new payment books, not great about making up their mind to what the proper coverage is for a home!! So, the new payment books keep coming, mortgage goes up and I am forced to pay it....VERY UNFAIR, and trying to get anyone at customer service to listen is just plain tiring!!!! Good luck to everyone else...I am ready to give them their key back!!!!

We contacted them Sept. 29th 08 and they just made a decision today, Nov 18th 08. None would tell us anything until today and we were told to start the progress all over again... We need help and tried to get to them prior to non payemnt and they didn't help.. We were told we have a deficit in income and don't qualify for anything. Also having a second mortgage didn't help. Aurora closing and laying off my daughter, her high-risk pregnancy causing 2 mo of hospitalization, her husband being in mortgage business as well, causing HUGE drop in income and NC doesn't care. Daughter working on computer from home and making $10 an hour, not sitting on her duff. She will be back to work making higher wages (hopefully) within 3 mo to make a difference with household income so NC doesn't HAVE to FORECLOSE, just negotiate and be patient. My kids will get it together! They are hard workers and had good credit. Why would NC make them crawl? Where is our GOV'T when we need them?

I think all Mortgage companies should help with differant work out packages. Possibly by differing a payment or two to the end of the mortgage could help save homes. They also will not accept a partial payment so we fall futher behind will waiting for help

I have been making monthly pmts. on time. I check my bank account to make sure all is well. I sent a pmt. to NCM on Dec.2 and just noticed (12/17/08) that check had not posted. I called NCM and they informed me all the payments I had been making were denied as they inceased the monthly pmt. They sent letters to the home where my soon to be x-wife lives, she didn't say anything, so I never knew. Had I known I would have Paid willingly. Bottom line , I called NCM in July this year to stop auto withdraw and start paying by check. They should have known how to contact me from that phone call. Also I have online contact, they could have used that.

Liars totally. I have filled out 6 workout packages and they did nothing except up my mortgage to $1665. per month. That's $300. more than what I was unable to make in the first place. They said I told them I made $2500. a month and could afford this. BS!!! They would not show me the paperwork either. Hired a mitigator and still nothing after 7 months. Then 2 weeks ago, I let a letter from them telling me they sold the mortgage. The people they sold it to are debt collectors. NCM is deceptive, liars, and have no intention of helping anybody. I hope their bank fails and they are all out of jobs and knows how we feel!!!

Not everyone can qualify for a loan modification, no matter what you are told. National City is a mortgage servicer, just like many companies, and they are bound by investor guidelines, meaning they can only qualify someone for a modification if the investor (the person that loaned you the money) agrees. Nobody wants a house to go into foreclosure, not the homeowner or the mortgage company. It doesn't benefit anyone financially. Hard times can happen to anyone but people need to be realistic. Sometimes as hard as it is to admit, if you can't afford your home there is no magic button mortgage companies have to just cut payments in half. Also, some people need to check their facts, National City didn't receive any of the bailout money.

After speaking with them and giving them all the info they said I was pre approved for a loan modification as I showed a surplus of income. I called to find the status weekly and they said there was no update and it usually takes 2-4 weeks to complete but not to worry as a foreclosure sale date was not set yet. I called again after 5 weeks and got the same answer of still processing. Then, 2 days later, I get the letter in the mail saying that the loan mod was denied due to a deficit in income and my loan has been referred to an attorney for foreclosure and they will not talk to me about it anymore. I have to go thru their lawyer to get any info and that too is a joke. I have called their lawyer numerous time and left meny detailed messages with no return call. I am trying to save my house but NCM or their lawyers dont care. I really dont understand this. I would think they would rather get money from me than have to foreclose and then try to sell the house in a terrible market in Florida. They will lose money by foreclosing and that just doesnt make sense to me. My wife and I are devastated and no one cares. I would suggest that anyone considering NCM find another option if at all possible. These people plain and simply DO NOT CARE if you lose your home or not. Avoid this company at ALL costs.

This company needs to stand up and be accountable for the way they conduct business in the mortgage market. The loan I am reporting about is a home loan in which the only borrower is my husband. In December 2007 I contacted NCM to request a payment booklet on the loan since the December payment used the last coupon and the escrow amount would more than likely increase (property taxes & insurance premiums). I did not inquire about any information on the loan itself just simply requested a new payment booklet for the upcoming new year and I was rudely informed that they could not speak with me since my name was not listed on the loan. I explained to this rude customer service representative that I was not inquiring about the loan just requesting a payment booklet and could she please just make a note to get the booklet ordered for us, again she replied that she could not speak with me in reguards to this loan not even to request a new payment booklet. Jan 2008 still have no payment book so again I called and was giving the same response. Feb called again and was told the same thing. So I had been making the payments without a coupon and at the old payment amount. March same deal they could not speak with me. So I did not make a march payment in hopes they would contact my husband in reference to his missed payment and they did so only they contacted him on his company work phone and left an urgent message for him to return their call which he did when he returned home from work that same day, and during this call he requested a new payment booklet and had explained they we had been requesting this booklet since december 2007 and she indicated that there was no record of this request, he gave her verbal permission to speak with me and I gave her the exact dates and times in which I called and whom I had spoken with and she indicated they because I was not listed on the account that no notation would be made of the calls or the request but that she would put the order for a new payment booklet in immediately. So I in turn went a made another payment in March, April and May without coupons since the payment booklet never was received until June and it indicated that the payment has been reduced by 87 cents a month which was no big deal until the following days mail ran and I received a notice from the homeowners insurance company which we have had for the last 12 years indicating our home was no loger insured due to non- payment of premium, which I could not understand since we had an escrow account and this money had been collected the previous year for the payment of this expense. I contacted the insurance company to be informed they had infact sent 3 different notices to NCM on this premium due and they received no payment and no response. Calls to NCM were not returned so again I did not make a June, July, August payment hoping they would again call us since they would not return our call and we did not receive a call but we were tracked down by a process server at a property which my husband is the beneficiary to in another city than were we live to be served with foreclosure papers and here is the clincher I was also served with papers on this mortgage which my name does not even appear and it is my former name prior to the marriage of my husband which I have not used for over 19 years. We turned the documents over to our Attorney who contacted the Attorney representing NCM and he had no type of loan information and it took him until October 2008 to receive the documentation we requested from the bank and we were shocked to also receive a new payment booklet from NCM in October while this was already in court on foreclosure with payment amounts increasing from 720.90 a month to 795.00 a month so with this we are informed that NCM Attorney does not know why a new payment booklet was issued on a foreclosure but that the increase in payment was due to mortgage insurance premium and he forwarded a copy of the loan history and I would discover that they allowed the premium on the homeowners policy to lapse for failure to pay the $456 premium but a month later had picked up a homeowners policy from their company with a premium of $804 and that was why the increase in payments but took them 3 months to notify us. In October our Attorney had us go to the bank and attempt to make the missed monthly payments from June to October including late fees but on separate checks for each month which I did and even paid the November payment early and they did except all the payments no questions ask. The payments cleared my bank also. Both Attorney's were amazed that the bank accepted the payments and they continued to workout the remaining issues. NCM is slow about providing documents needed to get this resolved and numerous request with the court for the hearing dates to be extended have been filed. In March 2009 we are informed that the payments we have made since october 2008 to Feb 2009 have been setting in a suspense account and never applied to the loan. NCM wants the payments paid at the payment booklet amount which was set in Oct and not the June rate and they will recalculate the payment amount when the case is settled and we pay the Attorney fees the incurred to file the foreclosure. They are also adding additonal late fees which they want paid. I understand the error on my part of not making the payments without a payment booklet but I also feel they NCM were in error of not getting a payment booklet out when the first request was made due to the fact they could not speak with me on the loan then they also should not have the power to file or list me on a foreclosure. And then the error of not using the escrow money in the manner it was being paid to be used for is outrageous and then to let our policy lapse and to pickup a policy for double the premium they should be prosecuted for fraud on this matter. This information was not giving to the Attorney filing the foreclosure by NCM but was issured to him from our Attorney. Now a new problem has come up I am waiting to file my income tax return because NCM has not issued us a 1098 mortgage interest statement for 2008 and when checking with the Attorneys we have been told we need to get that from NCM on our own. Which we have spoken with them and have been informed that the only interest applied to the account was from the payments made Jan to May 2008 and the remaining payments are still in the suspense account and no principle or interes will be applied to the loan until the etire case is completed. But we need to continue making the increased payments until this is refigured.

getting a live person on the phone is hot or miss. they are very slow to respond to me, yet when I was days late with my payment plan, they immediately filed a Notice of Default in my Courthouse. No delay there. They do not appear interested in working out a solution so I keep my home and so they get their money. It would make sound business sense for them to try to work with me yet they appear willing to lose thousands in a foreclosure, where no one wins.

National City Mortgage has not been very good to deal with. They will not take partial payments. Getting a person, not a machine, is almost impossibe. They kept my partial payment for two months before they returned it to me with a letter from their lawyers saying they were foreclosing on my home. I filed out a workout (hardship) packet and was contacted by their lawyers who basically told me they would would consider a repayment plan but they would need a down payment of at least 3,000-5,000 dollars to do so. If they had read my hardship packet, they could see I didn't have money for a down payment. Dealing with their lawyers is worse than dealing with them.

I'm currently working on my 3rd Hardship Packet with NCM. I've been denied twice advising the investor doesn't agree with modifying the terms. I've only been offered a repayment plan which would result in a higher payment of over $4k. I haven't made a payment in 11 months. I was served with the NOD in 1/09 with no sale date yet. I believe NCM hasn't received it's share of bail out money and is holding it's customers hostage until Washington pays out more.

I have to go thru their lawyer to get any info and that too is a joke. I have called their lawyer numerous time and left meny detailed messages with no return call. I am trying to save my house but NCM or their lawyers dont care. I really dont understand this. I would think they would rather get money from me than have to foreclose and then try to sell the house in a terrible market in Florida. They will lose money by foreclosing and that just doesnt make sense to me. My wife and I are devastated and no one cares. I would suggest that anyone considering NCM find another option if at all possible. These people plain and simply DO NOT CARE if you lose your home or not. Avoid this company at ALL costs.

National City is unethical. I locked with them last November at 4.8% for a refinance. Since then they have jerked me around with constant re-checking of my credit, repeatedly telling me they lost things like my pay stubs and now on third appraisal of my home. Yes, values have been dropping so now they are telling me they can't give me loan amount. Nine months, I make plenty of money, stable income, excellent credit in high 700's. I am gooing to file every complaint I can agaianst this company that, yes, has taken tax-payor bail out money. Our money at work fellow citizens!!

I have been requesting help from National City since September 2008. They refused to help me when my mortgage payments were still current. So after months of trying to get help with them, I finally stopped paying my mortgage in February. After three additional workout packet submissions, they are stil "in review" of my application. Yet, they did not hesitate to report my delinquency to the credit agencies nor to schedule a sheriff's sale on my home. Luckily I have a Fannie Mae loan, which keeps them from foreclosing on me until they complete the review of my loan. I have spent so much money and time dealing with them and after nearly a year of asking for help, I have received none.

We have been communicating to NCM since Oct 2008. They have no rational process for reviewing claims, and give misleading and arbitrary info on the phone. If you expect to get a loan modification from them, you are fooling yourself. Take it up with your congressman.

Due to a lapse in my coverage... insurance bill was sent to the wrong address. I was in contact with NCMC during entire process. At no point was I informed they would charge me a "fee" of more than the actual policy until they started pulling it from my account. bad business practices. I get the "poor service" comments. We are actually in good standing with NCM. When I called to do a re-fi with cash out, I got a GFE immediately, encouraging me to lock ASAP. However, when I tried to move forward, I did not hear back. Left two vm's and sent emails. Finally got a brief email explaining he was busy but would get back with me the next business afternoon. Next business afternoon came and went - late last night received another email telling me the re-fi would move forward ASAP. Asked for an updated GFE and have not heard back. I am so glad I found this website. After reading comments, we are going with another lender. NCM is losing our business and we have excellent dredit (by the grace of God) and an excellent payment history. The lack of communication is not acceptable - and I certainly don't want to risk the "cash out" payment to be held by NCM for 60m days! Thanks for all of your comments. Hopefully NCM won't read this and figure out who I am - sounds like they may lie about our payment history to discourage the next lender!

I'm currently working on my 3rd Hardship Packet with NCM. I've been denied twice advising the investor doesn't agree with modifying the terms. I've only been offered a repayment plan which would result in a higher payment of over $4k. I haven't made a payment in 11 months. I was served with the NOD in 1/09 with no sale date yet. I believe NCM hasn't received it's share of bail out money and is holding it's customers hostage until Washington pays out more.

These guys are the lowest form of pond scum I've ever come across... Last year I was diagnosed with cancer and was off work due to the operation I needed, then just as I was coming good from that I had 2 heart attacks back in November and had to have surgery for that, the topper came when the company I had a truck leased to (who had been in business for over 100 years) closed their doors. We were constantly in communication with NCM spent hours trying to navigate the VM system never got calls back, typical "We dont see your Mod request, could you please resend it" all the while telling us they would work with us. Finally after getting 6 months behind we get a notice of trust deed sale and frantically call NCM I swear our house was 1 hour from the auction block, when we got hold of the first decent person we've dealt with there. She called the auction company and put a 30 day postponement on the sale. So after 8 months of trying to negotiate a modification they came to us at the last minute and offered a Forebearance agreement, so now our payment which was $3175 has gon eup to $4762 a month for the next 18 months to allow us to catch up on back payments... Shoulda called a lawyer before signing the agreement and sending them a $6500 certified bank check as good faith. Now that we've signed the forebearance we cant do anything but wait for 6 months... But if this is any consolation to everyone thats been screwed by these people, we're about to walk away from the property we owe them $600K on a first and $141K on a 2nd and I've had a gut full, so they can come take my house and I'm filing BK, if the system wont work for me then I'm not going to work for it. So National Sh&%y come get your new home oh by the way current market value on this puppy is $405K...

I don't have any of those horror stories. I got a notice of default but I paid what they asked for in certified funds about 4 days after getting the letter. They did put my money in a suspense account and I had to call them to apply my money. But all is well now. They have applied my money and now I am current. They were very helpful to me and always talked to me at customer counseling. SOrry that everyone else is having problems. But there are still some helpful people with this company. Just keep calling like I did and you will get all the answers that you need. Times do get hard and circumstances will not permit sometimes. But of course my mortgage payment may not be as high as all of the others but pray as I did. Keep calling is all i have to say. Write the names down of the people that you talk to. Make sure you get the same information from different people. And if you are still in doubt please ask for a supervisor. They still do have some nice people in customer service.

About 3,000 West Virginians will soon get a check from National City Mortgage, as part of a settlement of a class-action lawsuit against the Ohio-based lender.
On Dec. 19, National City Mortgage agreed to pay 2,859 of its West Virginia customers for allegedly refusing to credit a partial payment or charging more than one late fee for the same late payment.
National City does not admit guilt in the settlement, but the company has agreed to pay a penalty of $700,000, including $151 for each refused payment or duplicate late fee. More than 60 customers with multiple infractions will receive at least $1,000.
"National City will not be doing those things in the future in West Virginia," said lawyer John Barrett of Charleston law firm Bailey and Glasser.
The 2007 suit accuses National City of failing to credit payments and charging illegal late fees, as well as "harassing and abusive debt collection practices."
The settlement became final earlier this month in the U.S. District Court in Charleston, in a hearing before Judge John Copenhaver.
According to the West Virginia Consumer and Credit Protection Act, a lender must credit any amount a borrower pays on a mortgage. Under the same act, a company may charge only one late fee for a late payment.

"West Virginia law is specific on these points," Barrett said.
The National City settlement joins a list of similar West Virginia settlements of lawsuits against national mortgage companies.
Since 2004, Charleston public interest law firm Mountain State Justice has won settlements of lawsuits against six major mortgage servicers. In every case, said attorney Bren Pomponio, the companies were refusing to credit payments and charging illegal late fees, among other things.
"That may sound like a small thing," he said, "but, especially for somebody on limited income, it can lead to foreclosure proceedings."

In September, National City attorneys moved to dismiss the lawsuit, arguing that federal law trumps West Virginia law, and their actions were legal under federal law, which is less stringent.

"Congress specifically enacted protections to ensure that national banking associations could, free from state intrusion, engage in 'all such incidental powers as shall be necessary to carry on the business of banking,'" National City attorneys wrote.
But National City management elected to settle the case.
Duplicate late fees will be erased, Barrett said. Un-credited partial payments are harder to remedy, he said, "because they can throw a person into foreclosure."
Aggressive, rude calls.The lawsuit was filed in June 2007 on behalf of Charleston resident James Muhammad and 2,858 other West Virginians "to prevent [National City] from needlessly and illegally placing their home loans into default and possible foreclosure," according to the legal complaint.
"I am very relieved that this case is settled," said Muhammad, who is program director for West Virginia Public Radio. "I have never sued anybody before in my life."James Muhammad gave people he didn't know a real gift by standing up for his rights," Barrett said."It began as a small issue for me, but it became clear to me that thes practices were leading to very serious problems for other people," Muhammad said. "And I just thought, well, if somebody doesn't do something, it will just keep happening. This whole thing did start in a pretty ordinary way," he said. In early October 2005, he mailed his monthly payment to National City Mortgage. "I grabbed the wrong coupon," he said. National City told Muhammad they would not credit his payment because it was $28.48 short.So he mailed them the $28.48, along with the next month's payment, according to the legal complaint."I had made a simple mistake. I corrected it. I thought that would be the end of it," he said But National City Mortgage mailed his original payment back, according to the legal complaint, and declared him in default.
He began to receive "daily, aggressive, rude phone calls" from National City at home, he said. He made all subsequent payments on time, the suit says, but the company still charged him a new late fee each month for more than a year.
He tried repeatedly to straighten it out, he said, "but they were very aggressive and difficult to deal with. You'd say you sent them money, and they'd say they didn't have it. But after you produced a canceled check, they'd say, 'Oh, we found it!'
"National City is not the only company that refuses to credit payments or charges unnecessary fees," Barrett said, "but you will not find local West Virginia banks doing this kind of thing. It's always an out-of-state lender."

West Virginia-chartered banks are governed primarily by stricter state law.

Refusal to credit payments involves hundreds of dollars, but the late fee is only about $15, Barrett said. But when it is multiplied by thousands, sometimes tens of thousands, it can amount to considerable money for the company, he said.

"These unnecessary fees are not often challenged because the amounts involved are not high. Really, this case is a great illustration of why class actions are so important to consumers when you have high-volume, low-dollar illegalities."
Muhammad said he has read the legal issues involved, "but the thing that disturbed me most was the level of disrespect the company showed their clients. I thought, OK, I'm just not going to take this.

"The odd thing is, a simple apology on a piece of paper would have done it for me," he said. "I always wanted to believe you could resolve most issues out of court with a company."

National City's attorney in Charleston - Bryant Spann at Allen Guthrie McHugh & Thomas - said the company declined to comment for this story.

National City Mortgage's decision to settle may have been influenced by the fact that the company is also contending with other lawsuits, including suits from its own stockholders who allege that company management misled them about the extent of the company's sub-prime mortgage problems.

In the past year, the company has cut dividends by almost half, shut down its wholesale business and laid off at least 1,700 employees, according to filings in the stockholder suits.

I am not writing this letter to evoke pity for my circumstances, but anger at National City Mortgage a company that just fails to do what is right for Veteran’s. (The company even settled a law suite in West Virginia in December for around 700,000.00 and had over 2000 plaintiffs for doing some of the same dirty tricks they are doing to me and other Veteran’s!) How can they keep getting away with it? I sure wish I knew about all of this before doing business with them!!!! Do not let this happen to other Veteran’s PLEASE! This is so wrong. Mortgage companies can not get away with devastate people, to pretend to help, while forcing them into a predicament that leads to their become needlessly homeless, like some predator lying in wait of pray, without suffering consequences.

My husband is retired Navy, a veteran who served his country for 23 that is why we have a VA loan. My situation is as follows:I was working as Registered Nurse in a Neonatal Unit when I got sick. I was sent to a Rheumatologist who diagnosed me with Systemic Lupus Erythematosus (LUPUS) and Psoriatic Arthritis. My Rheumatologist started me on medications and I began to feel better. I attempted to go back to work in nursing many times over the last few years and found that I failed. One day I will feel well and my pain level will be manageable. The next day I would hurt so much I could not get out of bed. My doctors and I made the decision that Nursing was not an option In February of 2008; I had to stop working out side the home completely. I applied for social security, but getting on SSI is not a quick process.

Without my income our mortgage fell behind by two months and fees mounted, I kept trying to catch up but National City Mortgage does not take partial payments. My social security came available in July for about $600.00 a month after Medicare part B payments.

I spoke with the VA rep and explained that we can afford to make the regular monthly payment on the house but we can not afford to pay the back due amount plus fees. The VA told me to request a workout package from National City Mortgage and request a VA loan modification on our loan. I put in the Workout package with National City Mortgage in July 2008. I tried to make a payment for the whole regular monthly payment for August but they would not accept it, and sent it back to me because they needed the entire amount due, all the back due as well to except anything, till we have a set arrangement.

I received my answer to my workout package in September 08, 2008. I was called by National City Mortgage, I was told, if I made my regular monthly payments on time starting on the 10/01/08 for six months. At the end of the six months National City Mortgage would do the VA loan modification and put the past due at the end of the loan, and if the current VA rate dropped, I could even get a lower rate, I thanked them for being so wonderful and promised to make the payments. I made my payments on the first of each month by western union, and I think everything is worked out with my mortgage, I was wrong.

In March I called National City Mortgage to do the modification on the loan. I was assigned to Ashley Childers in account Mitigations 1-800-367-9305 extension #53097 Ms Childers explained to me that in order to do a loan modification with the VA I need to get a full appraisal on my house, (that I need to pay for) and for National City Mortgage to do the modification it must be an appraisal for $280,000.00. I explained I only owe about $245,000.00, and with the market right now I did not think I could do better than $250.000.00. She told me that several other Veteran’s had tried to do VA modifications with appraisal just slightly under the values set by management, and they would not do the modifications for them. I explained that the only requirement told to me in last September was to make the 6 months of payments. Why did we not do an assessment then? I do not understand how this all happened? I am doing what National Mortgage said to do? She told me the best she could do was to offer me payment arrangements on the back do amount after the forbearances.

I ask her how much was the total back pay amount? She told me I owe 4 payments behind on my Mortgage, and fees. I ask her how the hell that was that possible, when I was only two payments behind in July when I put in the workout package. It turns out that because I was not able to make that payment in August, and when the workout package that came in September it had a payment start date of 10/1/09. So apparently they also are charging me for September 2008. I guess I was adding months to my delinquency by doing the workout package and following their instructions. Now I am behind for 4 month. I worked an arrangement to continue the forbearance agreement till August 2009. I am still making my monthly payments, and have been since October 08, but have no clue what to do now about the behind amount that is growing. I contacted the VA and spoke to my VA loan person John Downey 1-800-729-5772 ex 3934. I found out that for a VA modification, the VA does not require the appraisal, the appraisal was added by National City Mortgage. Mr. Downey said, “What they are doing is wrong, I knows it is happening to other veterans, but there is nothing I can do to help.”

Mortgage companies can not get away with devastate people, to pretend to help, while forcing them into a predicament that leads to their become needlessly homeless, like some predator lying in wait of pray, without suffering consequences.

We requested the National City Mortgage work with us to modify our mortgage while he was unemployed so that we could keep our home. When they finally responded - in February! - with a lower payment we thought this was a good thing. We were wrong!! The modified payment was only for a 3 month period - February, March, and April. In May they would re-evaluate and see where things stood. It is now June and we have heard nothing - except that they have now lost the financial paperwork we sent them - TWICE!!

That same month we were notified that the escrow account changed - it went up by almost $300 per month! - due to an error on their part. They had put in the wrong amount for the city real estate tax. This was brought to their attention immediately and we asked for the analysis to be redone - we were told we would receive a new analysis within 10 days. It didn't happen. We asked again in April - it didn't happen. We asked again in May - it didn't happen. It is now June and it still isn't done.

I called them today - 6/4/2009 - only to find out that the 3 modified payments we made have not been credited to the account. Where are they? National City doesn't know. According to them, we haven't made a payment since December 2008. News to us!! We have cancelled checks from the bank which National City has cashed. So, where did they put our payments? Why haven't they fixed our escrow account? Also, they won't accept any payments from us toward the mortgage until the Loss Mitigation Dept. advises them that a new agreement has been signed. We haven't seen any new agreement.

When I asked to speak to the manager of the department, I was hung up on 3 times! The fourth time I finally got connected to a manager's voicemail (Ms. Jai) only to be told that the "mailbox is full - goodbye."

We don't think National City has any intention of "helping" us at all. This is all a pretense. They are simply prolonging things and waiting until they can legally make a move to take our historical home away from us, since we owe much less than the home is worth. Well, here's hoping we "beat them to the punch." I just hired an attorney to file litigation against them!! I plan to sue them for anything and everything we can get. It might cost me money, but hell will freeze before I let them have my historical home!!

National City Mortgage has an outrageous and adverse practice of cashing a mortgage payment check, withdrawing the funds from the payers bank, then holding the funds for about a month, then sending the funds back by check to whatever address they have on file, then declaring that the account payment is overdue, and applying late fees, taking adverse credit reporting steps, etc. All this because they change the escrow payment amount, and if the payer does not get notice or make adjustment in payment, instead of showing a deficit in the escrow, they refuse to apply the payment at all!

This is about as insane a policy as I can imagine; they did it to me two years ago, and they have just done it again. I've asked them to contact me by email, but they refuse to do so.

This bank deserves to go broke and be taken over by a management that hopefully will be more customer friendly!

I closed a loan on November 4, 2008 and our loan was fully funded 2 days later. As part of our closing we were required to pay off our Taxes, then National City Mortgage would refund us the amount that we had in our Tax Escrow account (a little more than $5000). The law states that the Mortgage company must settle all accounts within 30 days, so we waited until mid-December and when we haven't received our check we called. The customer Service Rep said that our Check was just sent (December 15th) and we should get it within a week. I asked if they could sent it Next Day Air (at my expense) and they said they would.

Christmas came and went, no check, New Years came and went, no check. I called today Jan 02, 2009 and the customer Rep said that the check was printed on Wednesday.

The customer service rep admitted that they are in violation of the law, but I pointed out that I have been lied to on several occasions, that the check was " in the mail" and that they would send it "next day air".

I am going to pursue legal avenues but wanted others to be aware.

I have been in loss mitigation for 8 months now. Thats a long time, but National City was requesting everything under the Tuscan Sun to submit via fax only. Of coarse, they claimed to never recieve forms and when they did, it would take 4-6 weeks to process. I would call and be on hold for at least an hour (my lunch break). I would have to hang up and call again at 5:00 am in the morning. They are not west coast friendly!

To make a long story short, I finally recieved their workout offer. Get this... my payment went up a $100.00 higher!!! Are you kidding me! Is this what you call "help"?

My house is worth less than 1/2 of what I owe, I repeat, less than 1/2. Stockton CA market is unreal! They refuse to refinance me at current market value. Can anyone tell me why I should continue to fight? I have no neighbors, faxed, phoned & written forms and letters and this is my outcome.

Come on National City Mortgage, you know about getting bailed out, how about bailing out your consumer. Wasnt the releif meant for us?

I found myself in a financial crisis due to the falling real estate market.
I had borrowed money from a friend to get my credit cards paid and had been borrowing money to pay my mortgage and live. I had also taken a second job, but was unable to make much money at that job.

APRIL
In mid-April I put my house on the market, priced well below the appraised value that had been given me by National City (it was appraised at 750,000). Since I was unable to make my payments I was determined to sell it aggressively, though it meant losing money.
At that time I spoke with the National City Homeowner’s Assistance Department regarding my difficulties. They sent me an income-expense form and a request for further information. I returned that form within several weeks.

MAY
In May, I made a partial payment of $1000.00. Now, in reviewing all my documents I realized that I sent a partial payment of $1000.00, the check had been cashed and never reflected in any statement. Since I was required to pay the full amount that month, it seems that they kept the 1000. And they double billed me.
On a letter dated May 14 I received a letter advising me of a breach of contract and requiring a payment of $6519.22 on or before June 13, 2008. There was no mention of my application for a workout package
On a letter dated May 15, I received a letter from Consumer Counseling advising me that I was delinquent two months and the payment due was $4314.52. They gave me choices of several options but again there was no mention of my workout package that I had sent.
I had a conversation with the bank on May 28th. On May 30th I received a letter from the consumer counseling department (dated May 21) confirming a payment I had to make by May 31 (by cashier’s check). Of course that proved to be impossible with short notice and a national holiday. However I called and advised them that the check had been mailed overnight.

JUNE
On June 3rd, I received a note advising me that my mortgage was more than 30 days due and they attached a payoff statement. Since I had just been asked to resend the workout package because they could not find it, I was getting very panicked.
The above payoff statement was a s follows. June 1st was first scheduled payment. July 1st was next and every month on the same day through December. The payment was to be $1054.91.
On June 27 I received a second or third letter from the bank asking me for information regarding a workout package and I was again required to send the workout package since they told me they had never received it. I received another letter about it dated July 23, 2008). They requested a copy of my listing agreement which I immediately returned to the bank.

JULY
On July 7 I received another letter advising me of a breach of contract and requiring a payment of $6401.26 on or before June 13, 2008. There was no mention of my application for a workout package nor mention of all the previous letters.
On July 15 I received a letter regarding my loan being two months delinquent for the amount of $4196.56. Once again they were asking me to apply for a workout package. Which I sent out twice.

AUGUST
I received a letter dated August 11 advising me that my account had been referred to their attorney, Whittington and Aulgur. I was advised if I wanted to look at any alternatives I would have to contact the attorney. This was signed by the Foreclosure Department. I called the attorneys office twice and received no call backs.
I received a letter dated August 12 from the bank’s foreclosure committee and I was advised that it had been approved for a workout package. They offered me several new options including a modification package, a partial claim, a deed in lieu or a short sale. At this point I will say that there was several hundred thousand dollars of equity in the house that they didn’t notice and a short sale was not possible.
A letter was also mailed to me dated August 28 that the bank had reviewed the value of my house and determined that it was under-insured and that they were requiring me to raise the insurance policy.
I received a forbearance agreement dated August 29 , from the attorney’s office which I signed and returned regarding the payments.
September 2, 2008

Approx. mid-September I asked the Loan Department if I needed to send the payment due for October and November since the house was going to closing within a month I said an additional several thousand dollars would mean that I would have trouble buying food and medication.
The bank advised me that I would have to.....so I did

That same day I was called by a sheriff advising me that they had a package to give me. I was served with foreclosure papers at my house the next day. Clearly because of the timing, the bank had proceeded with the foreclosure before without waiting to see if I would make the payments. At that point I had to hire my own attorney and pay the bank’s attorney as well.

NOVEMBER
The closing date for my house was on November 14. I received no explanation at the settlement of the amount of money in interest and charges taken from the contract. Nor have I ever been able to get anything.

FYI:
The tactics used by this bank were unforgivable. In a period when even the smartest of us are confused, Intimidation
The level of intimidation by the bank was very high. My neighbors told me that they was calling about me. I would come home and find business cards from the bank telling me to call them. When I called they told me they could do whatever they wanted.
I wrote a complaint to the Better Business Bureau regarding this entire transaction. I received a letter via Fedex from the bank (the first time they documented anything via mail) denying any mistreatment (see attached letter). They claimed that they put me in foreclosure because of a telephone conversation I had with them in November. I paid November’s fee in October. (very confusing letter attached)

National City misrepresented the process of the workout package by sending me contradicting letters and time-lines. They advised me that they were my financial counselors and taking advantage of what was a very difficult time.
They pressed me to take a short sale when there was excess equity in the house
They provided me with inconsistent and contradictory records of the amounts I owed.
They provided no records of the money that I sent in a timely manner as agreed on for the workout package.
They did not disclosing the amount of money that had been paid to National City for the workout package (over 6,000). These were paid by two certified checks.
They forced me into a position where I had to pay for both my attorney and their attorney to handle what should have been a straight forward sale.
At the closing they gave no itemization, nor documentation of the money that I paid to them.
After the settlement they sent no documentation or itemization or accounting of the bank charges on the settlement sheet.
After the settlement, they sent no accounting of the dispersal of the escrow account.
Conducting all business in an undocumented manner based on misrepresented conversations.
I have attached several documents but this entire document was based on memos and letters from National City.

This is typical of the communication I had with the bank where its felt like I was communicating with 3 different people.

The other day I discovered they had cashed the check they put me in foreclosure over.
This blog is dedicated to those who have had any problems or fraud with National City Home Mortgage.

I am about to hire an attorney because they served a forclosure after I completed a workout package and just before I settled. Now...about 6 months later, they refuse to give me an audit on the monet they took from me.

My suggestion:
1. Do not do business with them if you have not started already

2. If you are having problems paying your Nat.City mortgage, seek state legal aid first and get their advice. Do not assume that their Nat. City's asistance services are there for anything other than to collect your money ASAP because they lie and keep incorrect records. Do not trust them. They are not very smart. The only good part of that is that they are unable to track dates and make a lot of mistakes for any future legal action.

3. Keep copies of everything you do with them, including phone calls, outgoing and incoming mail, checks and postal receipts. Get names and phone numbers. (they will often not give you names).

4. If you are having serious problems, you must start filing complaints to Federal and State organizations, as well as the Better Business Bureau. (I will get back with those links)

5. Copy all your complaints to PNC bank who was forced to take ouver National City as part of a Federal package.
